Trial of Trimble Outdoors applications for BlackBerry Smartphones
Terms And Conditions

This is a legal agreement which allows you, the end user, to use the Trimble Trial Software under certain terms and conditions. USE OR INSTALLATION OF THE TRIAL SOFTWARE CONSTITUTES YOUR FULL AGREEMENT TO THESE TERMS AND CONDITIONS.

The public trial of Trimble® Outdoors™ software applications ("SOFTWARE") for BlackBerry® Smartphones allows you to use free of charge for 30 days any or all of the following three applications:

• the AllSport GPS™ application
• the Geocache Navigator™ application
• the Trimble Outdoors™ application used conjunction with the Trimble Adventure Planner ™ software

Depending on what applications you will install, all or some of the following provisions shall apply:

• The AllSport GPS Terms of Use, Software EULA and Privacy Statement available at the AllSport GPS web site
• The Geocache Navigator Terms of Use and Privacy Statement available at the Geocache Navigator web site
• The Trimble Outdoors Terms of Use, Software EULA and Privacy Statement available at the Trimble Outdoors web site

In addition to the provisions of the abovementioned legal documents, the following provisions specific to pre-release trial software shall apply:

• The Pre-release Software is provided to you for testing purposes only. You are hereby granted a non-exclusive non-transferable license to install and use the Pre-release Software for testing purposes on as many smartphones as you require to accomplish the testing you choose to perform, subject to all of the other terms of applicable agreements and licenses. Once the testing period is over and if the Software is officially released your use of the released copy is limited to the number of devices for which you have purchased a license, as stated in the software license agreement distributed with purchased copies of the final release of the Software.
• The Pre-release Software may be tested up to the expiration date stated in Help/About dialog in the Software and/or in the message displayed when the Software starts and/or in other documentation which came with the Software. THE SOFTWARE OR PORTIONS OF THE SOFTWARE MAY CEASE TO OPERATE OR MAY NO LONGER BE USEFUL AFTER THE EXPIRATION DATE.
• Problems found in the Pre-release Software may be reported through the method(s) specified in the Software documentation. We can not promise any specific response to bug reports or feature requests.
• You agree to assign to Trimble all ownership interest in any feedback associated with your testing or evaluation of the Pre-release Software. Trimble or its affiliates will exclusively own and have title to all test results and feedback received from you (such as questions, comments, suggestions, data files), and any modifications or derivatives of the Pre-release Software based partially or entirely on these test results and feedback.
• We have thoroughly and comprehensively tested this Pre-release Software prior to making it publicly available, and believe that it is safe to use and will perform its functions properly. However, you are hereby warned that SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRIMBLE AND ITS SUPPLIERS DISCLAIM ALL WARRANTIES, TERMS, AND CONDITIONS, EITHER EXPRESS OR IMPLIED, BY STATUTE, COMMON LAW OR OTHERWISE, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES, TERMS, AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT WITH REGARD TO THE SOFTWARE, ITS SATISFACTORY QUALITY, AND THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES
• We do not warrant that a final release product of these pre-release versions will be issued, nor that any such final release, if issued, will include the same features and capabilities present in the Pre-release Software.
• LIMIATION OF LIABILITY. IN NO EVENT SHALL TRIMBLE OR ITS SUPPLIERS BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL OR PUNITIVE DAMAGES, HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS), ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE, OR THE PROVISION OF OR FAILURE TO PROVIDE SUPPORT SERVICES, EVEN IF TRIMBLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY EXCLUSIVE REMEDY PROVIDED IN THIS AGREEMENT. BECAUSE SOME STATES AND JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
• INDEMNIFICATION. IN THE EVENT THAT YOU USE THE SOFTWARE IN ANY MANNER NOT AUTHORIZED BY THIS AGREEMENT OR THE SOFTWARE DOCUMENTATION, YOU SHALL DEFEND, INDEMNIFY AND HOLD TRIMBLE AND ITS SUPPLIERS ENTIRELY HARMLESS FROM AND AGAINST ANY CLAIMS, LIABILITIES, DAMAGES, COSTS AND EXPENSES (INCLUDING ATTORNEYS' FEES AND COSTS) ARISING FROM OR IN CONNECTION WITH YOUR ACTS OR OMISSIONS.
