Rules for the GPS phone/software package draw

GPS PHONE/SOFTWARE PACKAGE DRAWING OFFICIAL RULES

Effective date: April 10, 2006.

Key points:

To help CITO event organizers and team leaders to enhance and encourage participation in their local CITO events, Trimble is donating 15 GPS phone/software packages to CITO teams based in the US.
Each package includes a mobile phone with Trimble Outdoors GPS navigation software, Trimble Adventure Planner trip planning and mapping software, and various accessories. Full information is available at the REI web site.
Recipients will be selected by Trimble from all eligible entries at Trimble's sole discretion. Preference will be given to CITO event organizers and team leaders rather than individuals.
Recipients will be entitled to use the packages donated by Trimble as door prizes at their CITO events, to keep them for use by their teams, or to use in any other way at their full discretion.
You must be based in the US for your entry to be eligible.
Your entry must reach Trimble by the end of Thursday, April 13, 2006, to be in the drawing.
Trimble intends to acknowledge all requests but can not guarantee that you will receive a reply.

How to participate:

To participate, send an email message to citopackage@trimbleoutdoors.com and include the following information:

Your name
Your address (must be in the US)
Your phone number
A brief description of your CITO team and your CITO event plans

PLEASE NOTE: Your entry must reach Trimble by the end of Thursday, April 13, 2006, to be in the drawing.

All entrants must be:

At least 18 years of age
Legal residents of the United States
Representatives of a team or an organization with three or more members

Employees and immediate families or household members of Trimble, its affiliates and subsidiaries are not eligible to participate in the Drawing.

Selection:

On or after 14 April, 2006, fifteen winners will be selected by Trimble at Trimble's sole discretion from all eligible entries received. All decisions of Trimble are final. The winners will be notified by email or phone if email addresses are not available. Odds of winning depend on the number of eligible entries received. The winners will be given two (2) days from the first day of notification to respond to claim prizes. A non-response by a winner or non-receipt of notification response after the specified two (2) days will be considered winner's forfeiture of the prize and an alternate winner may be selected from the pool of eligible entries. If an entrant is found to be ineligible, an alternate winner may also be selected from the pool of eligible entries.

Prizes:

Fifteen (15) winners will receive a package each that includes a mobile phone with Trimble Outdoors GPS navigation software, Trimble Adventure Planner trip planning and mapping software, and various accessories. Full information is available at the REI web site. Trimble reserves the right to substitute prizes of equal or greater value. Approximate retail value of the prizes are $230. The winners assume sole responsibility for all applicable taxes. The winners will be entitled to use the packages donated by Trimble as door prizes at their CITO events, to keep them for use by their teams, or to use in any other way at their full discretion.

General Conditions and Releases:

The Drawing is void where prohibited or restricted by law in the United States and is subject to all United States federal, state and local laws and regulations. All taxes, applicable custom duties and other obligations on the Drawing prize are solely the responsibility of the winners. An entrant or winner may be disqualified from the Drawing if he or she fails to comply with these official rules, as determined in the sole discretion of Trimble.

All entries become the property of Trimble.

By entering or accepting a prize in the Drawing, winners agree to be bound by these Official Drawing Rules and to conform to all federal, state and local laws and regulations.

By entering the Drawing, winners also confirm that they have read and agreed with Trimble Outdoors Privacy Statement, Trimble Adventure Planner End User License Agreement, and Trimble Outdoors Web Site Terms of Use. By entering, participants agree to release and hold harmless Trimble, its subsidiary and affiliated entities, directors, officers, employees, attorneys, agents, and representatives from any damage, injury, death, loss, claim, action, demand, or other liability that may arise from their acceptance and/or use of any prize or their participation in this promotion, or from any misuse or malfunction of any prize awarded.

Trimble is not responsible for any lost or late entries, electronic miscommunications or failures, technical hardware or software failures of any kind, lost or unavailable network connections, or failed incomplete, garbled or delayed computer transmissions which may limit an entrant's ability to participate in the Drawing.

Trimble is not responsible for 1) failed, returned or misdirected notifications based on inaccurate or incomplete information provided by the winner on the Drawing form 2) entries, and responses to winner notifications which are lost, late, incomplete, illegible, unintelligible, misdirected, damaged or otherwise not received by the intended recipient in whole or in part or for computer or technical error of any kind. Trimble reserves the right, in its sole discretion, to cancel or suspend this Drawing should a virus, "bug" or other cause beyond Trimble's control corrupt the administration, security or proper play of the Drawing.

Any person attempting to defraud or in any way tamper with this Drawing will be ineligible for prizes and may be prosecuted to the full extent of the law. Trimble reserves the right to modify the rules of the Drawing in any way or at any time. This Drawing shall be governed by California law. By participating in this Drawing, entrants agree that California courts shall have jurisdiction over any dispute or litigation arising from or relating to this Drawing and that venue shall be only in Santa Clara County, California.

Winner List:

By participating in this Drawing entrants agree that Trimble may announce their names in the event they are selected as the winners through the Community Forums or any other section of the Trimble Outdoors web site or in other media.
